Resumo

The reflections object of the present were originally presented in the II Luso-Brazilian Journey on Guaranteeism, at Instituto Superior Bissaya Barreto. I dealt, in a tight synthesis and without much bibliographic research, with the enumeration of problems associated with the projection of the word “guaranteeism” to other normative areas in addition to domestic constitutional law, due to the constitutionalization of international law and community law. In this sense, despite the voluntaristic and subjectivist impulse of the states in foreign relations, the legal regime constituted by post-national political institutions develops instruments that promote an objective normative order that aspires to assert itself imperatively over the political will, in symmetry to the internal constitutional paradigm, with which it begins to interact in a regime of constitutional syncretism that challenges the theoretical construction of public law as a hierarchical order. Delimited the object of reference of guaranteeism, which begins to incorporate new and autonomous material sources of constitutional values, it was concluded that this expansion provides a normative and judicial co-responsibility of constitutional law and constitutionalized international and community law, for the protection of fundamental rights, so that this constitutional syncretism starts to claim a control of legality that has as objective parameter normative instruments from all sources of public law, such as a conglobating constitutionality judgment, justifying the relations of preference applied concretely from the problems, and not abstractly, before them, from the norms.

  • Caíque Tomaz Leite da Silva , Universidade de Coimbra

    Doctorado en Derecho Público, con distinción, por la Facultad de Derecho de la Universidad de Coimbra, con inicio de investigación en el año académico 2010/2011, extensión certificada por la Universidad de Harvard (“Justicia”, por Michael Sandel), en 2020, y Universidad de Yale, en 2021 (“Fundamentos morales de la política”, por Ian Shapiro), y conclusión en el año escolar 2020/2021, con examen público en 2022. En 2010 completó el Posgrado en Derechos Humanos en el Centro de Derechos Humanos de la Universidad de Coimbra (Ius Gentium Conimbrigae), con 15 puntos. En 2014, completó el Postgrado en Derecho Civil y Procesal Civil en el Centro Universitario Antonio Eufrasio de Toledo, summa cun laude. Profesor Titular e Investigador Coordinador del Centro Universitario Antonio Eufrasio de Toledo, Profesor invitado en la Escuela Superior de Abogacía de la Asociación Brasileña de Abogados y Profesor invitado del Programa de Posgrado del Centro Universitario Unitoledo. Fue juez en el concurso de juicio simulado de la Corte Interamericana de Derechos Humanos, en la Facultad de Derecho de Washington en la Universidad Americana en 2011 y 2012. Formó parte del grupo de trabajo a cargo de la versión luso-brasileña de la obra “Entendiendo los Derechos Humanos”, del Centro de Derechos Humanos de la Universidad de Coimbra (Ius Gentiun Conimbrigae), en 2011/2013.
