Résumé

On 19 July 2024, the International Court of Justice (ICJ) delivered an advisory opinion on the legal consequences of Israel’s policies and practices in the Occupied Palestinian Territory. This article examines how the ICJ interpreted and applied international human rights law in that context, and the legal consequences arising from Israel’s conduct as an occupying power. In response to the questions submitted by the United Nations General Assembly in Resolution 77/247 (2022), the Court concluded that international human rights law is applicable in the Occupied Palestinian Territory and binding on Israel. The opinion highlights systemic violations of international human rights law committed by Israel, particularly in connection with measures of racial segregation, and points to possible legal remedies aimed at securing their cessation and ensuring reparation for the harm caused.

  • Catherine Maia, Sciences Po Paris

    Catherine Maia holds a PhD in International Law and is Associate Professor at the University of Maia (UMaia), also teaching at Universidade Lusófona and serving as Visiting Professor at several European institutions. Her research focuses on human rights, international criminal justice, humanitarian law, and peace and security. She is a judge at the French National Court of Asylum (CNDA), appointed by UNHCR, and collaborates as an expert with international organisations and States. She has authored and edited numerous publications on international law and human rights and is a frequent speaker at international conferences.
