PROFESSIONAL REHABILITATION IN BRAZIL AGAINST THE RIGHT TO WORK
Abstract
Abstract: In this article, from some preliminary considerations, we present the Public Policy of Vocational Rehabilitation as a service provided in Article 89 of Federal Law 8213/1991 of the Brazilian social security system. This policy brings,
in the formalization of the right, the proposal to enable conditions for workers with disabilities and/or with total or partial disability for their work function to return to the labor market with more security and dignity. However, we will demonstrate
that this social security policy is increasingly far from making the right to work effective, as a fundamental and constitutional human right. Here, we encourage the reflection about the effectiveness of this social security service in reaching,
what should be, its main objective, which is to qualify and rehabilitate in order to guarantee the social inclusion to work. Mainly because the precariousness of vocational rehabilitation came in the wake of social security reforms, with the
reduction of the State and the corrosion of work under the maintenance of the
neoliberal prescription since the 1990s.
