A NEW BRAND OF DEMOCRACY? THE CHINESE CASE
Abstract
Abstract: Aware of the non-recognition de jure of the internal dimension of the peoples’ right to self-determination, of the right to democracy, and attentive to the discourse adopted by China regarding the democratic regime, we chose to develop the problematic that the Taiwan case embodies to answer two essential questions. First, whether there is a new brand of democracy in China – approaching the democratic concept considering the work of Hans Kelsen. Second, to assess the meaning-consequence of this political debate in the international legal framework, notably for the recognition of a right to democracy.
