  1. In this issue, in addition to the texts approved through the continuous-flow evaluation process, articles related to the theme of this dossier, "Conventionality Control in Labor Law: A Comparative Analysis of Conventions with the Brazilian Legal System and Dialogues with the Judiciary," will be published.
  2. The thematic dossier aims to receive scientific articles and critical analyses addressing Conventionality Control in Labor Law, covering both its theoretical structure and its practical impacts at the international and domestic levels. It constitutes an important space for theoretical and empirical deepening, further expanding the dissemination of academic production by bringing together authors and readers interested in the specific proposed themes.
  3. With methodological rigor and diversity of approaches, the Dossier aims to highlight the impact of international instruments on Labor Law, both internationally and domestically, contributing to the consolidation of pathways aimed at strengthening the protection of workers' rights and improving legal dialogue in an increasingly globalized world of work.
  4. In this context, the Revista Ibérica do Direito (RID), in partnership with the Research Group on Gender Economics Analysis in Labor Law Law – “Grupo de Pesquisa em Análise da Economia de Gênero no Direito do Trabalho (AEGDT)” –, affiliated with the Federal University of Santa Catarina (UFSC), with financial support from the Government of the State of Santa Catarina, through the Foundation for Research and Innovation Support of the State of Santa Catarina (FAPESC), through this thematic dossier, invites researchers to submit proposals that address the theme through theoretical and empirical studies (quantitative or qualitative) from the perspective of Conventionality Control in Labor Law. Manuscripts must be original and unpublished, in accordance with the following research lines and their respective guiding questions:

All articles must establish connections with the UN Sustainable Development Goals (SDGs) and indicate, immediately after the title, which SDG the article relates to.

4.1 . Constitutional and International Foundations of Conventionality Control in Labor Law: this axis brings together studies that analyze international instruments within the framework of the International Labour Organization (ILO), the Inter-American Court of Human Rights, and the United Nations (UN), especially their relationship with Human Rights, the UN Guiding Principles on Business and Human Rights, and the 2030 Agenda.

Guiding questions:

  1. How can the United Nations Guiding Principles on Business and Human Rights (UNGPs) be operationalized through conventionality control in labor relations in Brazil?
  2. Based on the normative framework composed of the UN Guiding Principles (UNGPs) and UN resolutions, the OECD Guidelines for Multinational Enterprises on Responsible Business Conduct, the 2030 Agenda, and the Global Compact initiatives, what conduct is expected of companies in the labor field, particularly considering the international instruments regulating the matter and how they may interact with conventionality control?
  3. To what extent can conventionality control act as an instrument of corporate accountability and internalization of the costs of human rights violations at work, in light of international standards and the limitations of the Brazilian legal system?

4.2. Constitutional and International Foundations, from an Intersectional Gender and Race Perspective, in Labor Law: this axis covers analyses using different theoretical and methodological approaches, particularly intersectional perspectives of gender and race, focused on the compatibility processes between treaties, conventions, and other international instruments and domestic legislation.

Guiding questions:

  1. How have international human rights treaties been incorporated and interpreted within the Brazilian legal system when analyzed from the perspective of intersectional inequalities, particularly gender and race, in light of the dynamics of precarization, the feminization of poverty, and the informality of labor relations, as well as barriers to access to formal employment; and how do they systemically and disproportionately affect Black women?
  2. In what ways can international instruments for the protection of human and labor rights, particularly within the ILO, the UN, and the Inter-American Court of Human Rights, be mobilized, from an intersectional gender and race perspective, to reconfigure the legal protection of workers on digital platforms in Brazil, considering the challenges of legal classification, the intensification of precarization, and contemporary forms of algorithmic subordination?
  3. Regarding the intersectional perspective, how can conventionality control be used to achieve legal recognition of care work within labor relations, mitigating disproportionate impacts?
  4. In what ways can the conventionality control of national labor standards, grounded in the constitutional principles of dignity and equality, be exercised to invalidate ostensibly "neutral" interpretations that perpetuate structural racism and sexism, and to what extent does the incorporation of new international standards (such as ILO Convention 190) impose on the State and companies the duty to implement affirmative action and mechanisms to combat violence and harassment from an intersectional perspective?

4.3. Constitutional Jurisdiction, Dialogue Between Courts, and Conventionality Control in Labor Law: this axis is dedicated to the study of the role of constitutional and international courts in the reception, internalization, application, and methodology of conventionality control in labor law, as well as the hierarchy of treaties and international instruments within the Brazilian legal system and dialogues with the Judiciary, including transnational judicial dialogue and the use of foreign and international precedents.

Guiding questions:

  1. How can the application of international human rights promotion instruments by Brazilian courts complement, expand, and/or fill legislative gaps in the domestic legal framework for the protection of fundamental rights?
  2. In what ways can the application of conventionality control and the dialogue of sources serve as instruments for overcoming "legislative neutrality" in Brazilian Labor Law, particularly regarding norms that, although formally equal, produce disproportionately negative impacts on racialized and gendered groups? To what extent do State responsibility and corporate due diligence, in light of human rights treaties, require reinterpreting the concepts of subordination and working hours to account for the structural barriers that hinder Black women's access to, and retention in, dignified and protected jobs?
  3. Based on an analysis of Brazilian labor case law, what methods are used by labor courts to apply conventionality control? What are the main themes discussed?
  4. How can the Brazilian Judiciary exercise its role when confronted with collective agreements that relax labor rights, in light of Constitutionality and Conventionality Control?
  5. How has the Brazilian Judiciary engaged in dialogue with the case law of International Courts, particularly the Inter-American Court of Human Rights, in the context of labor relations? Are there standards that have been incorporated by Regional Labor Courts in Brazil?

  1. Particular value will be given to articles examining judicial decisions and the dialogues established between the Judiciary and international instruments, whether from an interpretive perspective or through the analysis of their concrete application via conventionality control. Contributions discussing the methodology of conventionality control, its theoretical foundations, the hierarchy of treaties and international instruments, as well as its relationship with Human Rights, the UN Guiding Principles on Business and Human Rights, and the 2030 Agenda, are also encouraged.
